FBDi points out duty of information

On January 15, the ECHA has added eight new SVHCs to the Candidate List following the SVHC identification process with the involvement of the Member State Committee (MSC). The Candidate list now contains 197 Substances.

Although the addition to the candidate list does not consist an authorization requirement for concerned manufacturers and/or importers, FBDi association expressly refers to immediate obligations for companies regarding associated substances included on the Candidate List. In particular, if a subassembly contains a SVHC in a concentration above 0.1% weight by weight, manufacturers and importers of substances are obliged to inform customers down their supply chain and consumers on the use of this substance. Within EU they have to hand out safety sheets, if they deliver SVHCs. According to a ruling by the European Court of Justice of September 2015 the 0.1% w/w concentration threshold also applies to all the constituent products of a given end product. In other words: where a product is made up of more than one article the relevance of each article in terms of SVHCs is to be determined irrespective of whether it is part of or will become part of another product.
The newly added substances are:
·         2,2-bis(4'-hydroxyphenyl)-4-methylpentane (EG-no. 401-720-1/ CAS-no. 6807-17-6); Toxic for reproduction (Art. 57c)
·         Benzo[k]fluoranthene (EG-no. 205-916-6 / CAS-no. 207-08-9)
Carcinogenic (Art. 57a), Persistent, Bioaccumulative and Toxic (Art. 57d)
·         Fluoranthene (EG-no. 205-912-4 / CAS-no. 206-44-0)
Persistent, Bioaccumulative and Toxic (Art. 57d), Very Persistent and very Bioaccumulative (Art. 57e)
·         Phenanthrene (EG-no. 201-581-5 / CAS-no. 85-01-8)
Very Persistent and very Bioaccumulative (Art. 57e)
·         Pyrene (EG-no. 204-927-3 / CAS-n0. 129-00-0)
Persistent, Bioaccumulative and Toxic (Art. 57d), Very Persistent and very Bioaccumulative (Art. 57e)
·         1,7,7-trimethyl-3-(phenylmethylene)bicyclo[2.2.1]heptan-2-one

FBDi: EU-wide ban on PFOA since 4 July 2020

On 4 July, PFOA - perfluorooctanoic acid, its salts and precursor compounds - was included in the POP (Persistent Organic Pollutants) Regulation (EU) 2019/1021 and at the same time also came into force in the REACh Regulation (Annex XVII, entry 68). FBDi association points out, that both regulations apply to PFOA with immediate effect.
